Workmen's Compensation

Workers Compensation Attorneys

Throughout our 25 years of service to the Southern Illinois and Eastern Missouri areas, our personal injury law firm of SCHREMPF, KELLY, & NAPP, LTD., has provided quality legal representation to clients who were injured at work or while performing tasks related to their employment.

We handle physical injury claims as well as those belonging to workers who developed an occupational disease involving exposure to dangerous chemicals or toxins like asbestos or benzene. Whether you are suffering from pain such as a lower back injury or are facing a serious disease due to exposure to workplace toxins, you may be entitled to workers compensation. We will do everything we can to get you the maximum benefits possible.

Our aggressive and compassionate lawyers are proud of their quarter-century of partnership experience in the field of workers compensation law. We have secured benefits and recovered cash settlements in a wide range of situations in which an employer is unsympathetic to an employee who sustains a serious injury or illness while on the job.

Full Compensation that You Need

An on-the-job accident injury can be a stressful experience. The worker has to deal with physical pain and financial strain, aware that bills need to be paid and decent medical care obtained. Mounting demands of insurance companies, doctor choices, and red tape of acquiring benefit checks often add insult to injury.

If you have sustained a serious workplace injury for which you deserve fair and just compensation for time lost at work, pain and suffering, and other important aspects of your life, SCHREMPF, KELLY, & NAPP, LTD. wants to hear about it. Contact us as soon as possible for your free initial consultation.

Our attorneys have represented injured workers for over 25 years. We are experts in the law regarding your rights when injured during the course of your employment. Your rights under Illinois law include:

  1. Your right to receive weekly payments while you are off from work due to your work related injury. This is called temporary total disability ("TTD"). This is equal to 2/3 of your average weekly wage. There are no taxes associated with these payments.
  2. Your employer must pay for all your necessary medical bills that result from your work related injury.
  3. The money you receive as a result of your work related injury is tax free.
  4. An aggravation of a pre-existing condition is also covered.
  5. The amount your attorney can charge is limited to 20% of the disputed amount.
  6. If your claim has been denied by your employers' insurance company, it is possible that decision can get reversed and a favorable award could be entered in your favor.
  7. The Illinois Worker's Compensation System is a no-fault program. This means that you do not have to prove that your employer was negligent.
  8. You may also have a claim to be filed against a "third party" if your injury was due to the negligence of another individual who is not employed by your employer.
  9. Repetitive trauma cases, such as carpal tunnel syndrome, are compensable under the Worker's Compensation Act. You can also recover for scarring and disease caused by chemical exposure
  10. If you cannot return to your employment due to your injury, your employer has to assist you in finding a new job or pay you a portion of your lost income. If you have to take a lower paying job as a result of your work injury, your employer is responsible for paying a portion of the difference in income.
  11. You may not be harassed, fired or demoted as a result of filing a Worker's Compensation claim.

Client Commitment that You Deserve

Our workers compensation lawyers are committed to giving you the individual attention you need. Insurance companies and their legal representatives are all too aware that you are up against statutes of limitations when it comes to acting to protect your legal rights, and that you might forfeit some of those rights if the aspects of your injury aren't handled with accurate attentiveness to time frames.

We'll act fast and work hard to safeguard your interests and protect your rights regarding medical care and insurance benefits.
